Terms of Service

These terms govern your access to UptimeMonk, a service operated by HostMQ LLC. By creating an account or using UptimeMonk, you agree to them.

Eligibility and accounts

You must be at least 18 and able to enter into a binding agreement. If you use UptimeMonk for an organization, you represent that you are authorized to accept these terms for that organization.

You are responsible for accurate account information, safeguarding access credentials, and activity performed through your account. Notify us promptly if you believe your account has been compromised.

The service

UptimeMonk provides cloud-based website, API, certificate, domain, port, and heartbeat monitoring features, along with alerts, incident information, reports, and status pages. Features and limits vary by plan.

Monitoring results and diagnostic explanations are informational. Network conditions and third-party systems can produce delayed, incomplete, or inaccurate observations. You remain responsible for operational and business decisions.

Authorized and acceptable use

You may monitor only systems you own or are authorized to test. You may not use UptimeMonk to disrupt services, evade access controls, scan systems without permission, send unlawful content, violate others’ rights, introduce malicious code, overload our infrastructure, resell the service without written permission, or break applicable law.

We may limit or suspend activity that creates a security, legal, or operational risk.

Subscriptions, billing, and taxes

Paid plans are recurring subscriptions billed in U.S. dollars. Monthly plans are billed monthly. Annual prices may be displayed as a monthly equivalent but are billed for 12 months in advance. Charges occur at the start of each billing period and subscriptions renew automatically unless canceled before renewal.

Published prices exclude taxes unless stated otherwise. You are responsible for applicable taxes. Plan limits and current prices are shown on the pricing page.

Cancellations and refund requests are governed by our Refund & Cancellation Policy.

Your content and data

You retain ownership of the information and content you submit. You grant us permission to host, process, transmit, and display it only as necessary to operate, secure, and improve the service and to meet legal obligations.

You are responsible for ensuring that your use of UptimeMonk and the data you submit comply with applicable law. Our handling of personal information is described in the Privacy Policy.

Our technology and feedback

UptimeMonk, its software, designs, documentation, and branding are owned by HostMQ LLC or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the service during your account term.

If you provide feedback, you permit us to use it without restriction or compensation, provided we do not publicly identify you without permission.

Third-party services

UptimeMonk may connect to authentication, notification, infrastructure, payment, and other third-party services. Their availability and terms are outside our control, and your use of them may be subject to separate terms.

Availability, termination, and changes

We work to provide a reliable service but do not guarantee uninterrupted or error-free operation unless a separate written service-level agreement says otherwise. We may change or discontinue features, including during beta development.

You may stop using the service at any time. We may suspend or terminate access for material breach, unlawful use, nonpayment, or a security risk. Provisions that by their nature should survive termination will continue to apply.

Disclaimers and liability

To the maximum extent permitted by law, UptimeMonk is provided “as is” and “as available,” without warranties not expressly stated in these terms. To the maximum extent permitted by law, HostMQ LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or business opportunities arising from the service.

Nothing in these terms excludes rights or liability that cannot legally be excluded.

Changes and contact

We may update these terms as UptimeMonk evolves. Material changes will apply prospectively, and the updated date will appear above. Questions may be sent to hello@hostmq.com.
